(hereafter "AKZU") warrants that its AKZU-branded products and accessories contained in the original packaging (hereafter "Product") against defects in materials and workmanship when used normally in accordance with AKZU's published guidelines for a period of Five (5) year (depending on different products) from the date of Product Delivery Note (“PDN”)--"PDN date". AKZU's published guidelines include but are not limited to information contained in Product Data Sheet, and Installation Manual. If, within the above specific period, any defects in materials and workmanship confirmed by AKZU, AKZU will, at its sole discretion, repair or replace the said products, and the two are the only and exclusive performances guaranteed under this “Limited Liability Warranty”.
The warranty shall only be effective subject to the following conditions
The products are used in compliance with the relevant specifications on the products and the relevant use (Product Data Sheet).
Any installation and/or assembly work is carried out by specialized technical staff on the product in compliance with the instructions accompanying the product (Installation Manual).
Temperature and voltage limit values are not exceeded and the product is not subjected to mechanical loads which do not comply with its intended use.
The product is maintained by specialized technical staff in compliance with any instructions accompanying the product.
The product shall not be changed/repaired either without the relevant written authorization or not in compliance with the enclosed instructions.
The customer shall submit to AKZU the corresponding invoice or any documentation accepted by AKZU.
The P/N label on products should be intact and can be clear enough for reading.
The defect, once it has been duly specified and its nature and scale have been duly shown, is reported in writing by the customer to AKZU within 30 days from its discovery subject to forfeiture.
The customer has duly paid for the product in compliance with the payment terms agreed in the sales agreement.
The warranty does not cover
Product defects due to unforeseen and unforeseeable events, i.e. accidental circumstances and/or force majeure (including electric shocks, lightning, etc.), unknown industry technical failures at the time of the delivery, or other unforeseeable circumstance outside of the range of the influence of AKZU that cannot be ascribed to a defective manufacturing process of the product.
Effective
Should the product be affected by defects covered by this Warranty and as long as the conditions under above paragraphs are met, AKZU shall be free to decide in its absolute discretion whether to repair and/or replace the product with the same or an equivalent product - subject to the technological progress that has taken place from the release of the original product. Any original product been replaced belongs to AKZU.
The warranty shall not cover
All extra costs resulting from any work needed to repair the defect (i.e. costs incurred to assemble / disassemble the product or to transport the defective / repaired /new product as well as expenses incurred for disposal, allowances, travel, lifting devices and scaffolding). Said costs shall be charged to the customer.
All parts subject to wear and tear, such as mechanical parts subject to wear and tear, as well as software defects, bugs or viruses.
Products marketed by AKZU under the brand of a different manufacturer.
The average service life of LED light sources means the length of time LED light sources still achieve more than 70% of the initial light output of luminous flux. Products within this range are not covered by this warranty.
Outdoor products are manufactured by AKZU through innovative manufacturing processes which ensure their high quality in terms of colorfastness as well as resistance to corrosion, abrasion and flaking. Said products are covered by this warranty as long as the defects, if any, affect their structural/mechanical safety and result from a defective product manufacturing process.
This warranty does not apply to AKODE LIGHT MANAGEMENT SYSTEMS.
A warranty can nevertheless be given on said AKODE Systems following AKZU assessment of the lighting scheme and the relevant installation.
Exclusive
If duly enabled, this warranty constitutes the sole and exclusive form of guarantee on the product offered by AKZU to the customer and expressly derogates from any other right, whether express and/or implied, acknowledged by the law to the customer, who renounces said right in the broadest manner allowed by the law as well as any other warranties given by AKZU.
The customer shall claim no further rights from AKZU in relation to the defective product. In particular, the customer may not claim from AKZU any expenses incurred in storing the defective/faulty product nor any other costs and/or compensation. Moreover the customer shall not request and/or claim any payment extensions, price reductions or the termination of the supply contract.

The Limited Liability Warranty is in Chinese and English edition. If there is any discrepancy between the Chinese and English version, the Chinese version shall prevail. This limited warranty applies to Chinese law.

Exclusive
If duly enabled, this warranty constitutes the sole and exclusive form of guarantee on the product offered by AKZU to the customer and expressly derogates from any other right, whether express and/or implied, acknowledged by the law to the customer, who renounces said right in the broadest manner allowed by the law as well as any other warranties given by AKZU.
The customer shall claim no further rights from AKZU in relation to the defective product. In particular, the customer may not claim from AKZU any expenses incurred in storing the defective/faulty product nor any other costs and/or compensation. Moreover the customer shall not request and/or claim any payment extensions, price reductions or the termination of the supply contract.

Please access and review the online help resources described below before seeking warranty service, or please contact an AKZU representative or, if applicable, an AKZU owned show center; AKZU representative will help determine whether your product requires service and, if it does, will inform you how AKZU will provide it, and will arrange service for you.
Limitation of Liability
Except as provided in this warranty and to the maximum extent permitted by law, AKZU is not responsible for direct, special, incidental or consequential damages resulting from any breach of warranty or condition, or under any other legal theory, including but not limited to loss of use; loss of revenue; loss of actual or anticipated profits (including loss of profits on contracts); loss of the use of money; loss of anticipated savings; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to, compromise or corruption of data; or any indirect or consequential loss or damage howsoever caused including the replacement of equipment and property, any costs of recovering, programming, or reproducing any program or any failure to maintain the confidentiality of information related to the using of AKZU product. The foregoing limitation shall not apply to death or personal injury claims, or any statutory liability for intentional and gross negligent acts and/or omissions.
Note
The Limited Liability Warranty is in Chinese and English edition. If there is any discrepancy between the Chinese and English version, the Chinese version shall prevail. This limited warranty applies to Chinese law.
